Why does my Human Touch chair have a Proposition 65 warning?
Human Touch® chairs may include a California Proposition 65 warning to comply with applicable California consumer-warning requirements.
What is Proposition 65?
California Proposition 65, officially called the Safe Drinking Water and Toxic Enforcement Act of 1986, is a California right-to-know law.
The law requires California to maintain a list of chemicals known to cause:
- Cancer
- Birth defects
- Other reproductive harm
The list includes naturally occurring and synthetic chemicals that may be found in consumer products, manufacturing materials, food, medicines, dyes, solvents, and other sources.
What does the warning on my chair mean?
A Proposition 65 warning means the product may expose a user to one or more chemicals included on California’s Proposition 65 list.
A warning is generally required when an applicable exposure may exceed a safe-harbor level established under Proposition 65. The presence of a listed chemical does not automatically mean that a warning is required; the anticipated level and type of exposure are also considered.
Does the warning mean my chair is unsafe?
A Proposition 65 warning does not necessarily mean that:
- The chair violates a product-safety standard
- The chair cannot be legally sold or used
- The chair will cause cancer or reproductive harm
- The chair contains an illegally prohibited substance
- The chair is defective
Proposition 65 does not ban listed chemicals. It requires applicable warnings so California consumers can make informed purchasing and usage decisions.
Why did I see the warning online and on the chair?
Proposition 65 requirements may apply at different points in the purchasing process.
For furniture, an applicable warning may be provided:
- On the product
- On the product packaging
- On the product page before an online purchase is completed
- At a retail display or another approved point of notice
For this reason, customers may see Proposition 65 information both before purchasing and again when the chair is delivered.
Are Human Touch chairs compliant with Proposition 65?
Yes. Human Touch chairs are labeled according to applicable California Proposition 65 warning requirements.
Proposition 65 compliance is not a certification that a product contains no listed chemicals. It means that Human Touch provides applicable consumer warnings as required by California law.
Does every listed chemical require a warning?
No. A warning may not be required if:
- The product does not expose the user to a Proposition 65-listed chemical
- The anticipated exposure is at or below an applicable safe-harbor level
- Another exemption under the law applies
Safe-harbor levels include No Significant Risk Levels for chemicals listed as causing cancer and Maximum Allowable Dose Levels for chemicals listed as causing reproductive harm.
